Formation of your contract with the Operator

We, Marin Alberca ltd, trading as Col Ascenders, act as agents for the Operators; when we display Operators’ Products on our Booking Channels, we are, on behalf of the Operator, inviting you to make an offer for their purchase.

Your contract with the Operator for the Product is formed as follows:

Once you have clicked “accept” on your price quote, you have made an offer to purchase the Product from the Operator for whom we are acting as agent.

We are authorized by each of the Operators to accept or reject your offer on their behalf.

When you purchase a Product, acceptance of your offer occurs when we send you an email confirming your booking, on behalf of the Operator. It is at this point that a contract is formed between you and the Operator for the Products.

All bookings are subject to availability. The Operators are requested to either confirm or reject a booking within the specified timeframe (which is generally within 24 to 48 hours of when the booking is requested, as determined by epico in its sole discretion) or the requested booking will be automatically cancelled.

Amendments, cancellations, no-shows and/or refunds

If you wish, or the Travel Experience Operator wishes, to amend or cancel your Travel Experience booking for any reason, we will deal with the amendment or cancellation as agent on behalf of the Travel Experience Operator. Your eligibility for refunds or any other compensation sought will be subject to any cancellation policy applied by the Travel Experience Operator, in accordance with your contract. Details of your Travel Experience Operator’s cancellation policy are made available to you at the time of booking and in your confirmation email.

Where authorised, we will pass any refunds or compensation we receive on to you.

If, as a result, your booking is cancelled and a new booking is made, please note that payment for the new booking and (if due) any refund on the cancelled booking will be processed separately, and it may take a minimum of 5-10 working days for the refund to be processed. By accepting these terms and conditions you accept this provision and the terms and conditions of the Operator that follow. Equally, acceptance of these terms grants permission to Col Ascenders to transfer your data to the operator for the sole purpose of fulfilling your contract with them.
Operator Terms & Conditions
Bike Hire and Guided Rides
All reservations for bike hire and guided rides with shall be subject to the following conditions:

1. Cancellation

If you need to cancel (a part of) the reservation this needs to be communicated to Grazalema Cycling Adventures by leaving a message on our contact page, by sending an email (info@grazalemacycling.com) or by telephone (0034 956 132 186 during our office hours or 0034 633 267 250). Cancellation of a reservation is only effective when Grazalema Cycling Adventures has confirmed the cancellation by email.

Cancellation charges are as follows:
Moment of cancellation:
- Until 15 days before the start rental period. No charges
- Within 15 days before start rental period. 20% of the total price of reservation

Grazalema Cycling Adventures reserves the right to cancel the bike rental or guided routes and in this event all costs paid will be returned, except when cancellation takes place for reasons of war, riots, civil strife, terrorist activity, industrial disputes, natural and nuclear disasters, fire, technical problems to transport like closure or congestion of airports, and similar events beyond the control of Grazalema Cycling Adventures.

Covid-19 Assurance Policy: In the event that you have to cancel your reservation of bike hire or guided ride with us due to reasons related to Covid-19, we will refund the full amount of the deposit you paid us. This also means that cancellations due to Covid of reservations of less than €100 (for which no deposit is required) will not imply any cancellation charges.
2. Liability
Grazalema Cycling Adventures is not liable for personal injury, death, damage to property or other loss whether arising from accident, cancellations, delay or any other matter beyond their control. Participants should insure against all such possibilities and are required to sign an Accident Waiver and Release of Liability Form upon collection of the bikes and equipment.
3. Payment Data Security
Grazalema Cycling Adventures will take all reasonable precautions to secure the payment data, including your personal and credit card information. We do not keep a record of your credit card details online, and will be responsible to ensure transmission of the data to banks is done so in a secure manner.
4. Privacy
The personal data you provide us with will only be used for the process of dealing with your enquiry and reservation. We do not use your data for marketing from third party entities, nor do we sell, share or allow access to the data to any third party other than as required by Spanish law.

Note: In the case that we hire bikes for you from a third party, like another bike rental company (because of limited availability or other reasons), then the terms and conditions for reservations, payment and cancellations of that company will be applied. If these terms and conditions differ from ours, we will let you know the differences before confirming your reservation.
